International insights relevant for the application of the new restructuring rules under the EU insolvency directive

On 24 March, Paul Kirkbright from Alvarez & Marsal UK gave a highly appreciated talk - organized by TMA Sweden - on his experiences on finding solutions in different jurisdictions and with various sets of rules, many of which have similiaries with the new rules on restructuring which will become effective in Sweden on 1 July 2022. Karl Björlin (Cirio) and Jonas Rickardsson (Alvarez & Marsal Sweden) made some introductory remarks on the upcoming Swedish restructuring rules. Paul Kirkbright provided many insights on how the negotiations between debtors, creditors and shareholders rules usually take form and concluded that the valuation of the debtor’s assets is a key element in most restructuring cases. An additional insight was that such valuations have been and may be challenged in restructuring cases.
